Terms and Conditions

The Food Store is a distributor, sales agent, and retailer of various artisan products.
We abide by the Consumer Guarantees Act and your purchase is coverable by New Zealand Law.

When a consumer purchases from us via our website or directly, your purchase is covered by the all the New Zealand consumer laws. Should your product be found to be faulty please contact us for replacement. We cannot refund opened items unless there is a product fault.

By placing an order with The Food Store, you confirm you have accepted our Terms and confirm that you have permission to place an order and accept said terms on behalf of the business or company you are representing. You also confirm that the owner/director or shareholder of the company agrees to be personally liable for all monies owed until all invoices are paid in full.

If you are acquiring goods for the purposes of a trade or business, you acknowledge that the provisions of the Consumer Guarantees Act do not apply to the supply of goods by The Food Store to you the client.

You do agree to receive the requested order at the address given at time of ordering and you have accepted the quoted price (wholesale price) plus GST and agree to pay for any freight charges.

If any of the Goods are damaged or destroyed during delivery, you must notify us within 7 working days to receive either replacement stock or a credit. Any insurance proceeds payable for the goods in transit is payable to The Food Store.

If you request your delivery to be left at an unattended location, then such goods shall be left at the client’s sole risk.
All stock is non-returnable and non-refundable unless prior arrangement has been made.

Any change of ownership of the business, requires you to pay all due invoices in full unless the new owner accepts responsibility for any outstanding invoices.

All purchases are payable on the 20th of the month following invoice date.

You agree and accept that any late payment may incur a penalty interest. At The Food Stores discretion, overdue invoices shall be charged penalty interest when payment has not been made when requested and overdue. Interest will be accumulated daily from the date notified to you, until the date of payment, at a rate of five percent (5%) per calendar month after as well as before any judgment.

The Food Store will also take steps to recover any due monies and you also indemnify The Food Store from and against all costs and disbursements incurred in recovering the debt (including but not limited to administration fees, legal costs for any solicitor and own client basis, collection agency costs, and bank fees).

By purchasing goods from The Food Store, you also acknowledge and accept that The Food Store is a distributor/wholesaler or agent for other companies’ products and brands. Whilst we abide and fulfil all our obligations of trade in New Zealand Law, the products responsibility to meet Health, Food and Safety Standards is the responsibility of the producer and manufacturer.
